This program will discuss the process and rational for utilizing a trustee’s discretionary authority to distribute the entire corpus of an irrevocable trust into a new trust under different terms when permitted by state law under a process commonly known as decanting which will include an analysis of the newly enacted Missouri statute (Mo. Rev. Stat. § 456.4-419).  In addition, this program will discuss the uses of a qualified spousal trust and joint spousal trust as a method of estate planning

Where Do I Go From Here? An Extended Overview of ESI, Forensics, and E-Discovery (2 Hr. CLE)
In the first hour, the presenter will introduce the complexities and challenges of electronically stored information in the legal context. In the second hour, preservation and collection issues related to digital
evidence will be presented, particularly in relation to the court’s expectations. The presenter will also cover the current case law and Civil Procedure statutes regarding electronic data.

ESI: Focus on Ethics and Considerations (1 Hr. CLE)
The ethics issues that arise during e-discovery of handling will be discussed in this presentation. The presenter will discuss the ethical issues encountered at each step of ESI processing including preservation, processing, and review; this includes the duty to preserve, ethical issues involving metadata, de-duplication, and the ethical use of technology to reduce review time. The presenters will also discuss the issues of licensing that have arisen within the e-discovery field. The presentation will conclude with a discussion of Rule 37 of the Federal Rules of Civil Procedure.

NOTICE --- New Ethics Requirement as of June 30, 2010 : Missouri Supreme Court Rule 15.05(f) has been amended to establish an annual requirement of two hours of education in professionalism, ethics and malpractice prevention per year rather than the previous requirement of three hours every three years.

CLE registration cancellations received at least 24 hours in advance of a CLE event will receive a voucher for the amount paid. The voucher will be dated the date of the cancelled CLE seminar and may be used at any future CLE event prior to the voucher expiration date.

The voucher expiration date will be one (1) year from the date of the cancelled CLE seminar.

A written voucher will be sent to the registrant for his/her records. A copy of the written voucher is maintained in a voucher file at KCMBA.

The dollar value of a voucher may be used toward any CLE seminar with the same registration fee or a CLE seminar with a lesser fee. No credit will be issued for the difference in fees. If a CLE seminar registration fee is higher than the dollar value of a voucher, the difference will be the responsibility of the registrant.

No voucher will be issued for "no shows" or for cancellations received less than 24 hours prior to the start of a CLE seminar.

If a registrant is a "no show" for a CLE seminar where a voucher has been used to pay the registration fee, the voucher is forfeited.

Registration fees will not be refunded.
